Terms & Conditions - Get Prepared App

1. Your access

By using the Get Prepared App you agree to these terms and conditions, which may be updated from time to time. The App, and any material generated by the App, is made available by Australian Red Cross (“Licensor”) to you under a non-exclusive licence for your personal use only. Licensor will handle your personal information in accordance with the Privacy Collection Notice on the App.

2. Intellectual Property

Licensor owns all intellectual property rights in the App (including any future upgrades or changes to the App). You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App. You own all intellectual property rights in any content that you include in the App (“Your Content”). You agree that Licensor may collect and use technical data (including but not limited to information about your device and metadata regarding your use of the App) for the purpose of providing the App to you and for research and development purposes. You will not upload any content that infringes on the intellectual property rights of a third party.

3. Termination

These terms and conditions will remain effective as long as you continue to use the App. Clauses 2, 4 and 5 will continue to have effect even after you stop using the App. Licensor reserves the right to suspend or terminate your use of the App at its discretion. Licensor reserves the right to change or upgrade the App from time to time, or to discontinue the App, at its discretion.

4. Liability

This App is provided to you for free. To the maximum extent permitted by law, the App is provided to you on a “as is” basis and Licensor disclaims all express or implied warranties or representations in relation to the App. To the maximum extent permitted by law, Licensor excludes all liability arising out of or in connection with this App or your use of the App, whether arising in contract, tort (including negligence), equity or otherwise. To the extent that liability is unable to be excluded, Licensor’s total aggregate liability to you for all damages will not exceed $10.

5. Other

These terms and conditions are governed by the laws of Victoria, Australia and both parties submit to the non-exclusive jurisdiction of the courts of Victoria. You must not use the Red Cross emblem or logo without permission. The Red Cross and Red Crescent emblems are protected symbols under international and Australian law and unauthorised use constitutes a criminal offence under the Geneva Conventions Act 1957.
